1. Acceptance of Terms

By accessing or using the Mentum platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Mentum reserves the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Mentum is an AI-orchestrated professional mentorship platform that connects professionals for growth through curated matching and focused 15-minute video sessions. The Service includes:

  • AI-powered mentor-mentee matching based on skills, goals, and compatibility
  • Credit-based session booking and scheduling
  • Video mentoring sessions via integrated video conferencing
  • Profile management and professional development tracking
  • Feedback and rating systems for quality assurance
  • Community features and notifications

3. Account Registration

To use most features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify Mentum immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service. Mentum reserves the right to refuse registration or terminate accounts at its sole discretion.

4. User Conduct

You agree to use the Service in accordance with all applicable laws and these Terms. You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose
  • Harass, abuse, threaten, or intimidate other users
  • Impersonate any person or entity, or falsely represent your affiliation
  • Share, distribute, or transmit inappropriate, offensive, or harmful content
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means (bots, scrapers) to access the Service without permission
  • Engage in no-shows or repeatedly cancel sessions without reasonable cause

5. Credits and Payments

Mentum uses a credit-based system for booking mentoring sessions:

  • Credits are included with your subscription tier or can be earned through mentoring
  • Credits are non-transferable and cannot be exchanged for cash
  • Unused credits may expire in accordance with your subscription terms
  • Subscription fees are billed in advance on a monthly or annual basis
  • All payments are processed securely through our third-party payment provider

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refund requests are handled on a case-by-case basis in accordance with our refund policy.

6. Mentoring Sessions

Mentum facilitates connections between mentors and mentees but does not guarantee specific outcomes from mentoring sessions. Users acknowledge that:

  • Mentoring advice is provided on a peer-to-peer basis and should not be considered professional, legal, financial, or medical advice
  • Mentors are not employees or agents of Mentum
  • Session quality and outcomes depend on the participation of both parties
  • No-show and cancellation policies apply as outlined in the platform guidelines
  • Sessions may be subject to a strike system for repeated violations

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Mentum and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit through the Service (profile information, session notes, feedback). By submitting content, you grant Mentum a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating and improving the Service.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

We are committed to protecting your data in compliance with applicable data protection regulations, including the General Data Protection Regulation (GDPR) where applicable.

9. AI-Powered Features

Mentum uses artificial intelligence to enhance the mentoring experience, including but not limited to:

  • Matching mentors and mentees based on compatibility algorithms
  • Generating profile enrichment suggestions
  • Providing session recommendations and insights

AI-generated recommendations are provided as suggestions only and should not be solely relied upon for important decisions. Mentum does not guarantee the accuracy or completeness of AI-generated content.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Mentum does not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. Mentum does not make any warranties regarding the results that may be obtained from use of the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENTUM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

12. Termination

You may terminate your account at any time through your account settings. Mentum may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and applicable member state legislation, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the competent courts of the applicable jurisdiction.

14. Changes to These Terms

Mentum reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting an update on this page and, where possible, sending a notification through the Service.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.
